The U.S. Department of Education’s Office for Civil Rights (OCR) enforces, among other statutes, Title IX of the Education Amendments of 1972. Title IX protects people from discrimination based on sex in education programs or activities that receive Federal financial assistance. Title IX states that:

No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.

Students, faculty and staff of the Barstow Community College (BCC) community, guests and visitors have the right to be free from sexual misconduct and any other form of gender-based discrimination and violence. All members of the campus community are expected to conduct themselves in a manner that does not infringe upon the rights of others.

BCC does not tolerate sexual misconduct, which includes, but is not limited to, domestic violence, dating violence, sexual assault, and sexual stalking. When an allegation of misconduct is brought to an appropriate employee's attention and a respondent is found to have violated any sexual misconduct district policies, appropriate sanctions will be used to reasonably ensure that such actions are never repeated.

This website is intended to define community expectations and to establish a mechanism for determining when those expectations have been violated. Likewise, the information gives reporting options to support students who have been victims of sexual misconduct. Under Title IX, discrimination on the basis of sex can include sexual harassment, rape, and sexual assault.

Examples of the types of conduct that violates Title IX include, but are not limited to:

  • Sexual innuendos and comments
  • Sexually explicit questions
  • Requests for sexual favors
  • Unwelcome touching, hugging, stroking, squeezing
  • Spreading rumors about a person’s sexuality
  • Sexual ridicule
  • Displaying or sending sexually suggestive electronic content, including but not limited to emails, text messages, etc.
  • Pervasive displays of pictures, cartoons, or other materials with sexually explicit or graphic content
  • Stalking a person
  • Acts of domestic or relationship violence
  • Attempted or actual sexual violence

On May 6, 2020, the U.S. Department of Education’s Office for Civil Rights (OCR) issued new regulations mandating how colleges and universities that receive federal funding must respond to sexual misconduct under Title IX. The Barstow Community College District values its diverse student population and is committed to maintaining a culture of respect. In furtherance of this commitment, the District and its Title IX Coordinator have carefully reviewed the new regulations and are in the process of collaborating across campus to establish a plan for how our campus can best implement these requirements. Given the new regulations had an August 14, 2020 implementation deadline, an interim policy/procedures has been established to comply with these mandatory legal regulations.  The interim policy/procedures are available at: https://go.boarddocs.com/ca/bccd/Board.nsf/Public

The District values and respects our participatory governance process. This interim policy/procedure will ensure a prompt and compliance grievance procedure while Human Resources and campus stakeholders finalize the formal District policies/procedures according to campus protocols.

Additional information will be shared as it becomes available. Any questions about Title IX can be sent to the Title IX Coordinator: :
